Dynamic Content and upload control?

Details
I am using dynamic content control to load a custom control containing a a file upload control connected a new document data source. When I save the document data source the document is saved but the uploaded file is not saved to the document.
My code is more complex than this but when I switched from rendering my custom control using scoped variables to using dynamic content it does not work anymore. so my code works, but not together with the dynamic content control.
is this a know problem?
